California Woman Sues City For $130,000 After Falling on Sidewalk.

A property owner has a duty to keep their property safe for others to use.  Part of that duty is maintaining a safe walking space, especially if you are a public area commonly visited by hundreds of people, such as a restaurant, store or supermarket. While tripping and falling may not always be harmful, it often leads to serious injuries and medical and other expenses, which an individual will have to live with and pay for themselves if they cannot properly recover their damages from a liable party, making a competent personal injury attorney essential. Sometimes, if the injury was on a public way, such as a sidewalk, the local municipality may be sued in order for a person to recover for their personal injuries.

Margaret Stewart was a local resident of Lodi, California and was being interviewed by a local newspaper reporter for her involvement with the neighborhood watch.  While doing the interview, Stewart tripped and fell on a raised sidewalk in front of 719 El Dorado Ave., severely injuring herself in the process. Stewart reportedly suffered a broken foot, a broken leg and a broken elbow as a result of the fall.  According to lawyersandsettlements.com, in addition to her initial trip to the hospital,  Stewart had to spend thirty-nine days in a Roseville convalescent home as a result of her injuries.

Stewart filed a personal injury lawsuit against the city of Lodi, alleging that their failure to maintain and properly inspect the defective sidewalk caused her injuries. Before going to trial, the two sides met and Stewart agreed to drop her lawsuit in exchange for $130,000 as compensation for her medical expenses, future pain and suffering and other damages.
