Dunkin Donuts Settles Personal Injury Lawsuit for Over $500,000 After Woman Slips and Falls in Parking Lot.

Businesses can be held responsible for injuries sustained on their premises. They have an obligation to their customers to keep a reasonably safe, secure environment. When a business fails to do so, its negligence can result in serious injuries, injuries they can be held financially accountable for.

Dunkin Donuts has recently settled a lawsuit filed in the Middlesex County Superior Court after a woman was injured in one of their parking lots located in Highland Park, New Jersey.  The woman, who has asked to not be named, left a Dunkin Donuts store after visiting a local strip mall when she tripped over an exposed spike in the parking lot.  This caused her to trip and fall, damaging her ankle and knee in the process.  Additionally, while she was falling, the woman spilled her recently-purchased coffee onto herself, causing painful and serious burns to her neck and face.

The exposed spike that was sticking out of the asphalt in the Dunkin’ Donuts parking lot was in direct violation of New Jersey safety maintenance standards. Business owners who neglect appropriate property maintenance and put their customers at risk for slip and fall accidents can be held accountable for their negligence. The woman’s lawsuit alleged that if Dunkin Donuts had properly maintained their parking lot, she would not have tripped and suffered her resulting injuries.  According to hg.org, rather than go to trial, Dunkin Donuts agreed to settle the woman’s lawsuit for $522,000 to compensate her for her medical expenses and pain and suffering.
