Man Receives $3.5 Million Settlement After Slipping on Snow and Ice at Construction Site.

In 2007, Kevin Montgomery was working for Tribco, a concrete company that was hired to lay the concrete structure for a condominium complex in Chicago, Illinois. Montgomery and two foremen were moving three carts of plywood sheets across a just-completed concrete floor on the 61st floor. However, there had been several days of snow and ice prior to Montgomery moving the carts. While Montgomery was moving one of the carts, he slipped on a patch of ice and twisted his back.

According to the Chicago Daily Law Bulletin, Montgomery filed a lawsuit against Bovis Lend Lease, the project’s general contractor. He alleged that the company allowed him to work in unsafe conditions, failed to reasonably inspect or provide adequate safeguards against injury, and required workers to move nearly 3,000 pounds of plywood when it was unsafe to do so. Montgomery alleged that the company should have halted work until the conditions were safe to continue.

Montgomery suffered a severe back injury from the accident and underwent two lumbar fusions. He also developed arachnoiditis, which is a condition that causes constant nerve pain.   As a result, Montgomery reportedly can no longer work in construction or any other industry. After the parties attempted mediation twice, Montgomery and Bovis settled for $3.5 million. Attorneys Christopher Norem and Amanda Martin represented Montgomery in this case.
