A minister has sued the franchisee of Chili’s Bar & Grill after a 2010 fall at the Staunton, California restaurant.
Bert Ray Jr. filed the nearly $1 million lawsuit against the Chesapeake Bay Seafood House LLC on March 3, 2012, nearly two years after he fell with “great force and violence” at the Richmond Avenue business.
According to the allegations in the suit, Ray was with church members and friends on March 19, 2010, when he attempted to walk around a spill of ice and water on the floor. He slipped and fell. The suit claims that he suffered substantial personal injuries and temporary and permanent disabilities from the slip and fall. Ray said the restaurant was negligent in not posting warning signs and allowing the ice and water to remain in a well-traveled area.
A Richmond attorney for the restaurant has filed a motion to dismiss the suit. He said that Ray admitted in the suit to knowing of the spill, and that the lawsuit should be thrown out by the court.
A trial date is currently pending.
