Nebraska Man Claims in Lawsuit that Wal-Mart Caused Wife’s Death by Failing to Double-Bag Her Groceries.

A man in Nebraska filed a lawsuit last week against Wal-Mart, alleging that a Wal-Mart employee’s failure to double-bag his wife’s groceries ultimately resulted in her wrongful death.

In early 2011, Lynette Freis purchased two 42-ounce cans of La Choy and a 2-pound bag of rice. A Wal-Mart employee placed these items in a single plastic bag. As Lynette was carrying her items in the plastic bag through the Wal-Mart parking lot, the bag broke. This caused one of the cans to fall on Lynette’s big toe and thereby caused her to fall. Lynette suffered a broken toe and a deep cut. The cut became infected, and Lynette was forced to undergo a series of operations and antibiotics treatments. Despite the operations and the treatments, however, Lynette passed away on March 12, 2011.

The woman’s husband, William Freis, has now filed a wrongful death lawsuit against Wal-Mart. Freis is alleging that Wal-Mart’s employee was negligent in failing to double-bag or separate the heavy items, and that this negligence eventually resulted in Lynette’s death. Freis is alleging that Wal-Mart is liable, as an employer, and also has primary liability for its own failure to train the employee to properly bag heavy items. Freis is also suing the manufacturer of the plastic bag for manufacturing and selling a defective product.

Freis is seeking $656,000 in medical expenses incurred in Lynette’s treatment, plus certain unspecified pain and suffering damages. Wal-Mart has indicated that the company will address the lawsuit in court, but offered condolences to the widower.
