A New Jersey man, Robert Samanns, was injured while using a treadmill that he purchased at a Sports Authority store in Pennsylvania. Mr. Samanns was walking on his Sportcraft treadmill at his home on February 5, 2013. Suddenly, he slipped when he was thrown off the treadmill and onto the ground. He sustained injuries to his back, neck, head, shoulder, and hip.

Due to his injuries, Mr. Samanns alleges he suffers constant pain, inconvenience, embarrassment and mental anguish. He also has a large amount of medical bills for his rehabilitation and allegedly has a diminished capacity to earn wages. The claim was filed at the Philadephia Court of Common Pleas against Sports Authority. The original claim also included the manufacturer of the treadmill, Sportcraft, but that company has been dismissed from the litigation due to bankruptcy. Mr. Samanns seeks over $50,000 in damages. He claims negligence and breach of warranty and his wife has a loss of consortium claim.

The complaint alleges that a salesman from the sports equipment chain failed to equip the treadmill with necessary safety devices, allowed the machine to be sold in a defective condition, did not investigate or inspect the treadmill for possible hazards to purchasers, and did not warn the Samanns family of possible dangers associated with the treadmill. The Samanns also state that the injuries sustained in the incident were completely due to the defective treadmill, and, therefore, the store should be strictly liable.
