Alan Dershowitz Files Slip And Fall Lawsuit Against Boston’s TD Garden.

Slip and fall accidents are the number one cause of emergency room visits in America. Dershowitz has been making headlines for decades, and 2015 is no different. Only this time, the story seems slightly trivial compared to his high profile cases. Dershowitz has filed a slip and fall lawsuit against Boston’s TD Garden nearly three years after he fell in an arena restroom.

According to Dershowitz, the slip and fall might seem trivial, but it is hardly trivial to him. As an older gentleman, he says the injury continues to bother him today. The accident occurred three years ago, during the fourth quarter of a playoff game between the Boston Celtics and the Miami Heat. Dershowitz has been a Celtics season ticket holder since 1965. He is an avid fan, to say the least. But on this particular occasion, he had to leave his seat to visit the restroom. On his way out, he noticed that the restroom was out of paper towels. The floor was damp, and as he tried to exit the restroom, he slipped and fell. He hurt his knee and landed hard on his back.

According to his lawsuit, the floor had been unreasonably slippery, and that slipperiness was caused by the lack of paper towels. Dershowitz’s lawsuit estimates the restrooms were out of paper towels for over an hour. During this hour, patrons were forced to either shake off their hands or let them drip dry. This caused water to accumulate on the restroom floor.

Despite his fall, Dershowitz waited until after the game to call for an ambulance. As reported by the Boston Globe, Dershowitz used the railings to pull himself back to his seat—just in time to watch the Celtics beat the Heat in the fourth quarter. Ultimately, Dershowitz’s medical bills totaled just under $6,000, including the ambulance ride. Still, he is seeking damages over and above medical expenses, to include pain and suffering and other economic and intangible damages.
