An elderly patron of CVS pharmacy in Florida was recently injured in a slip and fall accident inside the store, and is now suing the pharmacy for negligence in causing his slip and fall personal injuries.
David Katz, 82, of Fort Lauderdale, Florida arrived at his local CVS, as he does nearly every week, to pick up prescriptions and a few groceries for himself and his wife. The couple lives less than two miles away from the CVS in a private assisted living facility for active senior citizens.
Katz had been suffering from back and leg pains, but otherwise remained fairly active. Many of the CVS employees recognized Katz and greeted him on his arrival at the pharmacy. During this visit, Katz was passing through the frozen food aisle when one CVS employee called out his name, waving at him. Katz looked up from the floor to wave back, and in doing so, he did not notice the puddle of water that had formed on the ground a couple feet in front of him, apparently from ice that had come from the freezer.
Katz slipped on the puddle and fell on his back, causing significant personal injuries. Katz was unable to get up and an ambulance was summoned to take him to a nearby hospital. Katz was treated and sent home, but he now suffers more back and leg ailments due to the slip and fall accident.
Katz has brought a slip and fall lawsuit against CVS for the store’s negligence in allowing the puddle to form and remain a dangerous hazard to shoppers.
