A mother and son were shopping at Beall’s, a popular department store in Port Arthur, Texas, when the son slipped and fell on sunflower seeds that were on the floor. As a result of his fall, the son required hip surgery for a fractured hip.

Cynthia Smith, the mother, is bringing suit as next friend for her son. She filed the suit last year alleging that Beall’s Department Store failed to warn her son about the hazardous sunflower seeds on the floor. As a result of her son’s fall, he suffered a fractured hip and required surgery. The suit seeks damages for past and future medical expenses, pain, mental anguish, impairment and disfigurement. The mother is alleging that the store failed to provide her son with a safe place to walk, failed to warn about the hazardous condition, and failed to properly inspect and maintain the property. The case is expected to be tried later this year.
