Train Conductor Receives $280,000 in Personal Injury Damages for Slip and Fall Injuries.

A railroad worker from Clifford, PA has received $282,769 in personal injury damages to compensate for injuries he suffered after slipping on an icy railroad crossing in Taylor, PA. 

Jeffrey McAndrew, 44, was injured in the accident on February 21, 2010.  The accident occurred as McAndrew, who was employed by Delaware and Hudson Railway as a train conductor, was walking across a railroad crossing to flip a switch.  According to McAndrew, the crossing was covered with snow and ice, and he slipped and sustained serious injuries to his back. 

McAndrew sued his employer in 2011, claiming that he was entitled to damages under the Federal Employer’s Liability Act because the railroad company knew of the danger posed by snow and ice at the crossing and failed to address it.  The railroad responded that McAndrew was partly responsible for his injuries because he did not use reasonable care while walking despite the fact that it was snowing.  The railroad further noted that no one witnessed McAndrew’s fall, so his story could not be corroborated.

After a four-day trial, a jury awarded McAndrew a total of $627,288 in personal injury damages to compensate for his injuries and loss of wages.  However, the jury also found that McAndrew was 55% responsible for his injuries and the railroad company was 45% responsible, and McAndrews award was reducted to $282,769, reflecting his partial responsibility.
