Michael Bazzell, a resident of Granite City, Illinois, has sued a Granite City dental office for the personal injuries that Bazzell sustained while trying to get into the office by using the only available form of entry provided by the building, namely a staircase.
Bazzell, a paraplegic and wheelchair-bound man, has filed a lawsuit against the Granite City dental office seeking money damages for his medical bills, pain and suffering and other expenses arising from the injuries he sustained while trying to enter the office. According to Bazzell, on January 10, 2012, he was visiting the dental office for an appointment. He attempted to enter the office using a small stair in front of the building, because the structure was not equipped with a ramp. The stair was about four or five inches high, and he decided to try to roll his wheelchair over the stair.
As Bazzell attempted to do so, his wheelchair flipped backwards and he fell out of the chair. Bazzell struck his head on both the wall and cement floor outside of the dental office, sustaining a serious concussion.
In his complaint, Bazzell states that the dental office is responsible for his trip and fall injuries, because they failed to provide a ramp for disabled persons like him. Bazzell argues that the establishment was negligent in failing to provide this type of entry.
The dental office denies liability, and states that Bazzell should have paid better attention to where he was going.
Bazzell is demanding a total of $50,000 in personal injury damages.
