Sandra K. Blevins, of Harris County, Texas, is suing Walmart for a debilitating knee injury that she claims she suffered in a slip and fall accident while shopping in a Walmart store in Humble, Texas.
Blevins originally filed her lawsuit in the Harris County, Texas District Court in August. But the case was removed to the federal court in Houston on September 25 by Walmart, on the grounds of diversity of residency between Blevins and Walmart.
According to court documents, Blevins suffered a slip, trip and fall accident on August 26, 2011, while shopping in the freezer aisle at the Walmart in Humble.
Blevins claims she slipped on a puddle of water in the aisle, landing on her knee. She says that she suffered a debilitating knee injury as a result of the slip and fall accident.
Blevins says that the water collected in the aisle as condensation while workers were restocking the freezer shelves, and that the workers then failed to remove that condensation.
Blevins is seeking at least $500,000 in personal injury damages, claiming that Walmart negligently failed to maintain safe conditions in its store, and that she was not in any way responsible for her injury.
